Summary At a Glance
- Keep Them Current. Job descriptions should reflect actual duties, qualifications, and reporting relationships.
- Accuracy Supports Consistency. Descriptions help guide a variety of HR decisions where consistency is critical. Be sure they are supporting, not undermining, overall compliance.
- Strengthen Compliance Reviews. Clear requirements assist in workforce reporting, pay equity evaluation, barrier analysis, and selection practices.
- Assess Regularly. Create a procedure and frequency for description reviews, and make revisions when duties, technology, structure, or staffing needs change.
Job descriptions are often created and then left unchanged for years, even as responsibilities, technology, reporting relationships, and business needs evolve. Over time, the written description may no longer reflect the work employees actually perform.
Accurate job descriptions support more than recruiting. They can help employers make informed and consistent decisions involving reasonable accommodations, wage and hour classifications, compensation, performance management, workforce reporting, and other employment practices.
Why Accurate Job Descriptions Matter
- Essential Job Functions. Under the Americans with Disabilities Act (ADA), employers consider whether an individual can perform the essential functions of a position, with or without reasonable accommodation. A written job description prepared before advertising or interviewing may be considered evidence of what the employer views as essential. Distinguishing the true essential functions from duties that are outdated, infrequently performed, or merely preferred, is crucial.
- Qualifications and Hiring Requirements. Education, experience, licensing, physical ability, travel, and other job requirements should reflect what is actually necessary to perform the position. Periodic review can help identify requirements that may no longer be relevant or job-related.
- Compensation, Classification, and Performance. Job duties and responsibilities may affect exemption classifications, compensation decisions, career levels, and performance expectations. When a job description no longer reflects the actual position, employers may have difficulty applying these practices consistently.
- Workforce Data, Compliance, and Reporting. Accurate job descriptions can also support workforce reporting, pay equity analyses, and reviews of employment practices by providing context beyond job titles alone. Clearly defined duties and qualifications can help employers evaluate EEO classifications, identify potential barriers in job requirements, establish consistent selection criteria, assess similarly situated employees, and review whether recruiting or technology-assisted hiring practices are aligned with legitimate job requirements.
A Timely Shift for Federal Contractors
Federal contractors have an additional reason to review job descriptions following recent changes to Section 503 of the Rehabilitation Act.
Effective September 21, 2026, covered contractors will no longer be required to solicit disability self-identification information, apply the 7% utilization goal, conduct related utilization analyses, or use Form CC-305.
However, Section 503 non-discrimination, affirmative action, and reasonable accommodation obligations remain in full effect. Accurate job descriptions can help employers identify essential functions, evaluate accommodation requests, and document legitimate job requirements.
Recommended Next Steps for Employers
Employers should consider taking the following steps:
- Review Job Descriptions vs. Actual Duties. Confirm that descriptions reflect current responsibilities, reporting relationships, and required skills.
- Confirm Essential Functions and Qualifications. Review education, experience, licensing, physical, travel, and other requirements to ensure they remain job-related and necessary.
- Review Classification and Compensation Practices. Confirm that job descriptions support appropriate wage and hour classifications, compensation decisions, and workforce reporting.
- Establish a Regular Review Process. Review job descriptions periodically and whenever duties, technology, organizational structure, or staffing needs change.
