OSHA’s Guidance on Reopening for Non-Essential Businesses

On June 18, 2020, OSHA issued “Guidance on Returning to Work” for non-essential businesses. The guidance sets forth three phases for reopening, and OSHA states that “During each phase of the reopening process, employers should continue to focus on strategies for basic hygiene, social distancing, identification and isolation of sick employees, workplace controls and flexibilities, and employee training.”

Next Steps

Employers should review this updated guidance, as well as ensure that they continue to follow the guidelines as required by NY Forward (as applicable). Where federal and state guidance differ, employers must adhere to the guidance that provides the greatest protection for employees.
