An Updated EEOC’s Know Your Rights: Workplace Discrimination is Illegal Poster Must be Posted Tomorrow 

The Pregnant Workers Fairness Act (PWFA) goes into effect on June 27, 2023 and also requires employers to post a notice describing protections under the PWFA. For this reason, the EEOC’s Know Your Rights: Workplace Discrimination is Illegal poster has been updated.

The requirement to post this notice applies to employers with 15 or more employees. 

Next Steps for Employers

Effective tomorrow, June 27, employers must remove the prior version of the poster and replace it with the updated version. The poster should be displayed in a prominent location at the worksite and may also be provided electronically.

A Spanish version of the poster is also available for download on the EEOC’s website, in addition to versions for those with vision and hearing impairments.

As a reminder, New York employers also have an obligation to post all required federal and state notices in the workplace and provide those notices electronically either by website or by email. Because this federal posting specifically applies to both applicants and employees, employers should also ensure that applicants also have electronic access to this notice.
