CA Pay Data Reporting Updates for 2023

On January 19, 2023, the California Civil Rights Department (CRD) announced updated guidance for employers on changes to the 2023 Pay Data Reporting requirements, including an FAQ for the 2022 reporting year.

Among these changes is the reporting deadline, which is now the second Wednesday in May each year. The deadline to file 2022 data is May 10, 2023.

Other notable changes to reporting requirements include:

  • Payroll Employee Report is now required for all covered CA employers, regardless of whether the employer is required to file an EEO-1 report.
  • A separate Labor Contractor Employee Report is now required for private employers with 100 or more workers hired through labor contractors in the prior calendar year (with at least one worker based in CA).
  • Mean and median hourly rate calculations are now required.
  • Increased monetary penalties for employers who fail to file, and against labor contractors that fail to provide the necessary data to filers.
  • EEO-1 reports will no longer satisfy the reporting requirements

CA Pay Transparency Law

Pursuant to Senate Bill 1162, covered employers must report pay and hours-worked data by establishment, job category, sex, race, and ethnicity to the Civil Rights Department (CRD) annually.

Reporting Requirements

Employers who meet the following criteria are required to file CA Pay Data reports on an annual basis:

  • All employers with 100 or more employees and/or 100 or more workers hired through labor contracts, with at least 1 employee and/or labor worker based in CA

Additionally, labor contractors are required to provide employers with the necessary data for filing.
