The EEO-1 filing platform is open and accepting reports for the 2024 data collection. All reports should be submitted electronically via the EEO-1 Component 1 Online Filing System.
Who Must File?
Private employers subject to Title VII with 100 or more employees in any pay period between October 1, 2024, and December 31, 2024, are required to file one or more 2024 EEO-1 Component 1 reports.
An employer with fewer than 100 employees is required to file if the employer owns, is owned by, or is affiliated or associated with another employer, such that there is centralized or common control, ownership, or management, and the combined employers meet or exceed 100 employees. Filers with affiliated employers can distinguish company data, such as EIN and NAICS, per establishment and per employer within a single filing account.
Additionally, federal prime and first-tier subcontractors are required to file if they have both 50 or more employees and a contract, subcontract, or purchase order valued at $50,000 or more, unless the employer is exempt under 41 CFR 60-1.5. Financial institutions with 50 or more employees are included in this filing requirement.
The requirement for federal contractors to file EEO-1 reports is pursuant to the now-rescinded Executive Order 11246. Despite this rescission, both the filing system and EEO-1 Instruction Booklet continue to identify federal contractors with 50-99 employees as required filers for the 2024 data collection.
How to File?
Employers should submit their EEO-1 reports online at EEO-1 Component 1 Online Filing System in accordance with the EEO-1 Instruction Booklet. This year’s filing deadline is June 24th. EEOC has indicated no extensions will be granted and the system will close at 11:00 pm Eastern on June 24th. Any required filer who has failed to submit a report prior to the deadline will be out of compliance.
Active account holders should have received multiple messages from EEOC beginning on May 20, 2025, including a notification that the system is open, a Company ID, and an employer PIN. Anyone who has not received this information and is unable to log into the system is encouraged to create an account and contact the Filer Support Team to have the account linked to the proper employer as soon as possible to avoid non-compliance.
Employers who filed EEO-1 Component 1 reports for the 2023 data collection but no longer meet the filing requirement should still log into the system and complete the 2024 filer eligibility questions to avoid receiving a violation notice.
HR Works EEO-1 filing clients may contact their Consultant with any questions about completing the filing process.
What’s New?
Consistent with Executive Order 14168, the 2024 EEO-1 Instruction Booklet removes the option to report non-binary gender employees in the Comments section; all employees must be reported as either male or female. In instances where an employee has declined to self-identify a binary gender, it is appropriate for the employer to make a visual identification.
The opening of this year’s data collection was accompanied by a message from EEOC Acting Chair Andrea Lucas, reminding employers that EEO-1 demographic information may not be used to discriminate against employees, including for purposes of furthering diversity in the workplace. The full text of Chair Lucas’ message can be viewed on the EEO-1 website.
While the EEO-1 filing season has been extended in recent years, EEOC asserts that June 24, 2025, will be the final day any reports are accepted.
Filing information, including FAQs, Fact Sheets, Instructions, and a User’s Guide, is posted on the EEO-1 website.
