Form I-9 Expiration Date

The current Form I-9 expired on August 31st. The Department of Homeland Security (DHS) is expected to extend the current version of the form without changes, although minor clarifications will be made to the form’s instructions. DHS has not yet provided a new expiration date for the form.

Next Steps
Based on past practice, employers may continue to use the current (expired) Form I-9. Once DHS releases a revised version, employers will be required to use the updated form for any employees hired on or after that date.
