Indiana Governor Signs Legislation Creating Pregnancy and Childbirth Accommodation

On April 21, 2021, Indiana Governor Eric Holcomb signed legislation (HB 1309) creating a new pregnancy and childbirth accommodation law for employers with 15 or more employees. Under the law, employees may submit a written request to their employer for a workplace accommodation related to their pregnancy (including childbirth or related medical conditions) and their employer must respond to it within a reasonable time. Employers may not retaliate against an employee for requesting or using this accommodation. However, an accommodation request does not:

  • Require that employers provide it; or
  • Impose a duty or obligation on the employer to provide it or a policy exception, unless existing federal or state laws require an accommodation, such as the Americans with Disabilities Act (ADA).

The law is effective July 1, 2021.
