Maine Updates its Salary Level to Reflect the FLSA

The minimum salary for executive, administrative, and professional employees in Maine exempt from minimum wage and overtime requirements will align with the federal Fair Labor Standards Act (FLSA) minimum salary level.

Maine law requires this minimum salary to be higher of either 3,000 times the state minimum hourly wage or the federal minimum salary. Since the FLSA minimum salary will be higher than 3,000 times Maine’s minimum wage from July 1, 2024, this federal rate will set the new minimum salary standard for exempt employees in Maine.

Next Steps

Employers with exempt employees in Maine should ensure that they are familiar with the federal salary level requirements which will increase on January 1, 2025, to $1,128 per week ($58,565 per year). Salary adjustments or reclassification of employees to non-exempt workers entitled to overtime pay may be necessary.
