Massachusetts Employees Can Now Use PTO to Supplement PFML Benefits

The Massachusetts Paid Family and Medical Leave (PFML) law was recently amended to allow employees to supplement, or “top off,” their weekly PFML benefits with their accrued paid time off (PTO). Effective November 1, 2023, employees who are on PFML leave can now use their PTO to receive up to 100% of their wages during their leave. Previously, employees were not permitted to supplement their PFML benefits with PTO. Employees can use any type of accrued PTO, such as vacation time, sick leave, or personal time, to supplement their PFML benefits.

Next Steps

Employers should update their policies and procedures to reflect the new PFML topping-off provision and provide information to employees about the new PFML provision, including how to use it and how it will be coordinated to ensure that the PTO usage does not exceed the employee’s accrued PTO balance.

Additional guidance on the PFML topping-off provision is available in these frequently asked questions (FAQs) from the state.
