Minnesota Bans Salary History Inquiries 

Effective January 1, 2024, Minnesota employers may not inquire into, consider, or require disclosure of the pay history of an applicant for employment to determine compensation or benefits for that applicant, except if, the applicant’s history is a matter of public record under federal or state law or the applicant voluntarily and without prompting discloses pay history, and the employer considers that information to support a wage or salary higher than initially offered.

Employers should review and update their recruiting and hiring practices including employment applications and interview questions to remove inquiries regarding prior salary history. Employers should also train recruiters and hiring managers on permissible and prohibited questions and practices.
