In 2024, Missouri voters approved a measure (Proposition A) introducing mandatory Paid Sick Time (PST) for private employers that takes effect on May 1, 2025, whereby existing employees will begin accruing paid leave, and those hired after this date will begin accruing on their first day of employment. Employers should ensure that they are prepared to comply with the law including the poster and notice requirements which are now available from the Missouri Department of Labor (DOL).
For background, employers must provide written notice regarding PST to employees within 14 days of their start date or by April 15, 2025, whichever is later. This notice must inform employees of their rights under Proposition A, including accrual rates, protections against retaliation, and information on reporting violations. Employers must also post a notice which will be developed by the state containing the same information.
Additional details on the paid sick leave law and its requirements are available in a prior post from HR Works. The DOL has also developed frequently asked questions (FAQs) to assist with compliance.
Next Steps for Employers
To ensure compliance with the law, employers should ensure that they download and post the poster in a conspicuous location. Additionally, they should ensure that their onboarding process includes providing the required notice to employees at hire and that existing employees receive the notice by April 15.
Employers should implement a policy that clearly outlines the accrual rates, eligible uses, carryover provisions, and documentation requirements. Employers should also be prepared to adjust their payroll systems to accurately track the accrual and usage of paid sick leave, implement a recordkeeping system to maintain accurate records of employees’ sick leave balances, provide training for human resource personnel and management staff on the law’s requirements, and ensure they understand and can effectively communicate them to employees.
