Effective June 2, 2021, the definition of race under the Nevada Fair Employment Practices Act is amended (SB 327) to encompass traits associated with race, including hair texture and protective hairstyles. Protective hairstyles include natural hairstyles, Afros, Bantu knots, curls, braids, locks and twists.
The amendment does not limit an employer’s ability to enforce health and safety requirements set forth in federal or state law.
Employers should review and update their existing equal employment opportunity and non-harassment/non-discrimination policies to include updated language regarding the term race. In addition, employers should review and update their existing dress code and/or or grooming policies to remove reference to any prohibition on protective hairstyles.
