On May 25, 2021, Governor Steve Sisolak signed Assembly Bill 47, which modifies some of the provisions under NRS 613.195 that regulate the use of non-compete agreements. Effective October 1, 2021, non-compete agreements may not apply to workers who are paid hourly, excluding tips. In addition, employers are restricted from bringing lawsuits to enforce certain non-compete agreements.
Employers should consult with counsel to prepare updated template agreements to ensure that their non-compete agreements contain the most up-to-date provisions for enforceability.
