New Hampshire’s New Firearm Storage Law: Implications for Employers

Effective January 1, 2025, New Hampshire’s new firearm storage law (RSA 159:27) will impact workplace policies for public and private employers receiving public funds. This law primarily addresses the storage of firearms in employee vehicles on employer property.

Key Provisions of the New Law

  • Permissible Storage: Employers cannot prohibit employees from storing firearms or ammunition in their locked vehicles, provided the firearm or ammunition is not visible.
  • Protection for Employees: Employers cannot take adverse actions against employees who comply with the law. They cannot inquire about firearm storage or search employee vehicles without legal justification.
  • Employer Liability: Employers are generally not liable for damages, injuries, or deaths resulting from the lawful storage of firearms in employee vehicles.
  • Exemptions and Limitations: The law does not authorize employees to carry firearms in locations where they are legally prohibited.

Next Steps

To ensure compliance with the new law, employers should:

Review and Update Workplace Policies:

  • Amend policies that prohibit firearms on employer property to allow for lawful storage in locked vehicles.
  • Ensure policies do not infringe on employees’ rights to store firearms in compliance with the law.

Train Employees:

  • Train supervisors, managers, and HR personnel on the law to avoid unlawful inquiries or actions.
  • Emphasize the importance of respecting employee rights and avoiding discriminatory practices.

Review Security Measures:

  • While the law provides liability protections, employers should continue to prioritize workplace safety and security.
  • Encourage employees to secure their vehicles and firearms responsibly.

Seek Legal Advice:

  • Consult with legal counsel to understand the specific implications of the law for your organization.
  • Address any potential liability concerns and ensure compliance with all relevant regulations.

By understanding and implementing the provisions of this new law, employers can maintain a safe and compliant workplace while respecting the rights of their employees.
