New Jersey AB 1897 which passed on February 22, 2021, goes into effect on August 1, 2021. The act prohibits New Jersey employers from inquiring about or taking adverse action against an applicant solely based on any arrest, charge, conviction or adjudication of delinquency for certain cannabis-related offenses. Further, employers may not require an applicant to disclose or reveal such arrests, charges, convictions or adjudications.
Employers should review their hiring practices and ensure that hiring managers and/or recruiters have been properly trained on the aspects of the law.
