New York Paid Family Leave Contribution Rates Increase for 2022

The New York Department of Financial Services (DFS) has announced New York Paid Family Leave (PFL) rates for 2022. PFL is insurance that is funded by employees through payroll deductions. Each year, the DFS sets the employee contribution rate to match the cost of coverage.

Effective January 1, 2022, the PFL contribution rate will remain at 0.511% of gross weekly wages; however, the annual cap will increase from $385.34 to $423.71.

What Is PFL?

PFL provides eligible employees up to 12 weeks of job protected leave to:

  • Bond with a newly born, adopted or fostered child,
  • Care for a close relative with a serious health condition, or
  • Assist with family situations when a family member is deployed abroad on active military service.

PFL may also be available in some situations when an employee or their minor, dependent child is under an order of quarantine or isolation due to COVID-19. Additional information is available on the state’s COVID-19 quarantine leave page.

How Much Can an Employee Receive While on PFL?

Employees taking PFL receive 67% of their average weekly wage, up to a cap of 67% of the current statewide average weekly wage (SAWW). For 2022, the SAWW will increase to $1,594.57, up from $1450.17 in 2021. The maximum weekly benefit amount for PFL in 2022 will be $1,068.36.

Employers should work with their payroll providers to ensure that the required contribution amounts are deducted and capped appropriately. Employers should update any PFL related materials which are provided to employees including providing waiver forms to those employees who are eligible to waive PFL. Employers should also provide training to human resource personnel and supervisors/managers who have responsibilities for addressing employee leave requests to ensure confidentiality is maintained, required notices are given and that time off is designated appropriately.
