New York Paid Family Leave to Cover Siblings

On November 1, 2021, Governor Kathy Hochul signed legislation (S.2928-A/A.06098-A) to expand the covered family members for which NY Paid Family Leave may be taken to include “siblings”. Under the current law, employees cannot take leave to care for a sibling with a serious health condition. This change will take effect on January 1, 2023.

Under the legislation “sibling” is defined as a biological or adopted sibling, a half-sibling or stepsibling.

Between now and effective date, it will be necessary for the state and insurance carriers to develop updated PFL forms and guidance.
