The increased salary level (for the executive and administrative exemptions) for the remainder of New York (NY) state has been proposed, and salary level increases throughout the rest of state will go into effect on 12/31/21 as follows:
- NYC (Manhattan, Brooklyn, Bronx, Queens and Staten Island) will remain at $1125/week
- Long Island (Nassau and Suffolk Counties) and Westchester County – $1125/week
- Remainder of the state – $990/week (proposed)
The salary level for professional and computer employees follows federal law.
Next Steps for Employers
NY employers should review their compensation levels and make necessary changes by December 31, 2021. Updates might result in increasing an employee’s hourly wage or salary or reclassifying exempt employees to non-exempt if they will no longer meet the exemption salary requirement.
To comply with the New York Wage Theft Prevention Act, updated pay notices may need to be provided to employees who are being reclassified as non-exempt.
