Federal construction contractors and subcontractors will be required to submit monthly employment data reports (Form CC-257) starting March 1, 2025. Reports will cover a calendar month and be due on the 15th of the following month unless the 15th falls on a weekend or holiday, on which the report will be due the next business day.
The reports will require data on employee work hours, race/ethnicity, gender, and trade which the Office of Federal Contract Compliance Programs (OFCCP) will use the data to enforce equal employment opportunity laws and identify potential discrimination.
Contractors can also use the monthly reports to monitor their own equal employment opportunity (EEO) efforts and take corrective action.
Next Steps for Contractors
Construction contractors can ensure compliance with the new reporting requirements and maintain a strong EEO program by:
- Reviewing the CC-257 Form. Familiarize yourself with the specific data requirements of the form.
- Establishing Reporting Procedures. Develop a system to collect and report the required data monthly.
- Training Employees. Ensure that employees responsible for data collection and reporting understand the requirements.
- Monitoring EEO Compliance: Continuously monitor your EEO practices to identify and address any potential issues.
- Stay Updated on Regulatory Changes. Keep an eye on any updates or changes to the reporting requirements, especially given the potential for changes under a new administration as it is unclear whether the incoming Trump Administration will keep this new reporting requirement in place before the first reporting deadline.
