The Ohio General Assembly recently enacted changes to the Revised Code affecting youth employment compliance requirements. Employers in Ohio who hire minors must now update their workplace practices to reflect these new obligations.
Under the Ohio Revised Code:
- Employers must maintain a complete list of all minors employed at each establishment.
- Employers must post a printed abstract summarizing the provisions of Chapter 4109 of the Ohio Revised Code, which governs minor employment.
The required list must be posted in plain view in a conspicuous location frequented by the largest number of minor employees. All minor employees must have access to this location.
The abstract was also previously required to be physically posted but the changes in the law now permit employers to post the abstract electronically. If the abstract is posted online, the abstract must be accessible to all employees, ensuring minors can easily locate and view the information. This update provides greater flexibility for employers who maintain electronic communication platforms or employee portals. The Director of Commerce will continue to furnish the required printed abstract, ensuring employers have the correct summary of the law.
Next Steps for Employers
Employers who hire minors in Ohio should:
- Review current posting practices and ensure the printed abstract is properly displayed or made available online.
- Verify that the list of minor employees is up to date and kept onsite.
- Confirm that all postings, whether physical or digital, are easily accessible to minor employees.
