Proposed NYC Law Expands Sick Leave to Include Care for Pets and Service Animals

The New York City Council has introduced legislation (Initiative 1089) to amend the administrative code, allowing employees to use accrued sick time to care for certain animals. The proposed law defines a “covered animal” as either a service animal or an animal kept primarily for companionship, provided it complies with applicable laws, such as licensing and housing regulations. If enacted, this legislation would expand the permissible uses of sick time under the City’s Paid Safe and Sick Leave Law to include medical diagnosis, treatment, or preventive care for a covered animal, as well as care for an animal experiencing a physical illness, injury, or health condition.

Next Steps

If enacted, employers would need to update their sick leave policies to reflect this new provision, revising employee handbooks and communicating the changes to their workforce. Businesses would also need to consider how to document animal-related sick leave requests while maintaining compliance with privacy standards. This expansion of sick leave could lead to increased absenteeism, prompting employers to evaluate operational impacts and develop strategies to manage workforce scheduling. Training for managers and HR staff would be essential to ensure consistent application of the new policy and avoid disputes.

To prepare, employers should monitor the legislation’s progress, consult with legal counsel to update policies, and plan for potential operational adjustments resulting from increased sick time usage. If passed, the law will take effect 120 days after being signed, providing a limited window for businesses to implement necessary changes. This proposed legislation highlights the growing recognition of the key role pets and service animals play in employees’ lives, offering employers an opportunity to support their teams while staying compliant with evolving local laws.
