As of February 1, 2022, covered federal contractors and subcontractors (contractors) were able to begin registering for access to the new online Contractor Portal from the Office of Federal Contract Compliance Programs (OFCCP), which collects information about their affirmative action program.
Who Must Comply?
Under Executive Order (EO) 11246, contractors that meet certain jurisdiction thresholds have an obligation to develop and maintain written Affirmative Action Programs (AAPs).
Portal Use
Contractors must use this portal to certify, on an annual basis, whether they have developed and maintained an affirmative action program for each establishment and/or functional unit, as applicable. In addition, the portal will provide a secure place for scheduled contractors to submit their affirmative action program(s) to OFCCP during compliance evaluations.
Next Steps for Employers
OFCCP will send an email to each covered federal contractor in its jurisdiction (whose email information is available in its system) inviting them to register. On March 31, 2022, contractors will be able to use the certification feature in the portal to certify their AAP compliance. By June 30, 2022, existing contractors must certify whether they have developed and maintained an affirmative action program for each establishment and/or functional unit, as applicable.
Employers should visit the agency’s website for additional information on the OFCCP’s Contractor Portal webpage which includes frequently asked questions. OFCCP will also be providing additional compliance assistance, such as a user guide and How-to-Videos soon.
