Adding to the string of significant actions in the past week, OFCCP announced on July 2, 2025, that the abeyance on Section 503 and VEVRAA compliance enforcement has now been lifted. Under Order 08-2025, issued by Secretary of Labor Lori Chavez-DeRemer, federal contractors can expect:
- Complaint processing under Section 503 and VEVRAA will now resume. OFCCP will contact parties affected by complaints that were held in abeyance in late January to notify them of this change. The agency will also begin processing new complaints as normal.
- Compliance reviews held in abeyance will be administratively closed. Impacted employers will receive notices from OFCCP confirming the closure. The November 2024 Scheduling List will no longer be used for scheduling upcoming compliance reviews.
- The Contractor Portal Certification period will remain closed while OFCCP revises its processes and systems.
- The enforcement moratorium exempting Veterans Affairs Health Benefits Program (VAHBP) providers from compliance evaluations will extend through May 7, 2027. VAHBP providers remain subject to investigations as a result of complaints.
Executive Order 11246 enforcement will not resume and OFCCP has proposed a full rescission of the EO 11246 implementing regulations. The comment period for that rescission will remain open until September 2, 2025.
HR Works clients with compliance reviews that had been held in abeyance, who appeared on the November 2024 Scheduling List, or who have an unresolved conciliation agreement with OFCCP are encouraged to contact their HR Works AA/EEO Consultant with questions.
