Update on New York Paid Sick Leave Policy

As the New York Paid Sick Leave (NYPSL) is now in effect, employers should have begun employee accruals on September 30. Employees will become eligible to use accrued sick leave on January 1, 2021.

The state still has not issued its final regulations and guidance which are expected to address many unanswered questions related to administering NYPSL. As a result, HR Works will hold off on issuing sick leave policy language for our handbook database. However, we will have updated policy language available with the 2021 legal updates (or sooner). 

Next Steps for Employers

Based on guidance from our legal counsel, until further guidance is received by the state, we recommend that employers hold off on creating a policy or updating an existing policy. 

Employers who do wish to update their policy immediately, should ensure to address the key areas of accrual, usage and carryover. This policy should also be reviewed by legal counsel before distributing it to employees.
