USCIS Extends Green Card Validity: Key Considerations for Employers

U.S. Citizenship and Immigration Services (USCIS) has recently announced the implementation of a significant change to the validity period for Green Cards. Effective September 10, 2024, the automatic extension period for Permanent Resident Cards (Green Cards) has been increased from 24 to 36 months for Lawful Permanent Residents (LPRs) who file Form I-90 to renew their expiring or expired cards.

Impact on Employers

This policy change can streamline human resource (HR) processes by reducing the frequency of re-verification for LPRs. Employers can now continue to employ LPRs for up to three years beyond their Green Card expiration date, as long as they have a valid I-90 receipt notice.

Key Points for Employers

  • Form I-9 Completion: When completing Form I-9, employers should note the new expiration date (36 months past the “Card Expires” date on the Green Card) and include “PRC Ext” and the I-90 receipt number in the “Additional Information” box.
  • Document Retention: Employers should retain both the expired Green Card, and the I-90 receipt notice for their records.

Next Steps

To ensure compliance with this new policy, employers should:

  • Update Internal Procedures: Modify internal I-9 procedures to reflect the 36-month extension period.
  • Train HR Personnel: Conduct training sessions for HR personnel and hiring managers to familiarize them with the policy change.

By staying informed about this policy change and implementing appropriate procedures, employers can maintain compliance with immigration regulations and avoid potential legal issues.
